BAH #6 is actually exciting, not boring! A pending Trademark will get you early access to Brand Registry, even if you don't utilize the IP Accelerator program. This can save you time and money! (as long as you have done the research to know your Trademark is not too similar to another company's Trademark, in which case yours will be denied)

Boring Amazon Hack #6... scratch that, Exciting Amazon Hack #6!Did you know early access to Brand Registry isn't restricted to the IP Accelerator program anymore? I decided this wasn't actually a boring hack, but is something to get excited about. As long as you have a pending Trademark, you can gain early access to Brand Registry benefits. Historically, this access was only granted if you went through the IP accelerator program and used one of Amazon's IP partners to file for a Trademark. This is great news if you have a pending trademark before launching on Amazon, or if you want to save some money and file a trademark yourself instead of using an Amazon partner for it. (As little as $250 vs. $1,000+ for the Accelerator program)Using the IP Accelerator program can still be beneficial, particularly for getting legal guidance on your Trademark to ensure it will be approved by the USPTO.It should also be noted that the early access to Brand Registry gives you all of the content benefits, such as A+, Stores, etc., but does not give you access to filing copyright infringement claims against sellers using your pending Trademark. This option is only given to brands with granted Trademarks (to prevent abuse).

Copyright and softwareDigital platforms, which mainly consist of software, are easy for competitors to copy and are therefore vulnerable to imitators. Intellectual property is particularly necessary and valuable to protect against copycats in the digial industries. One option is to utilise copyright protection, as can be seen in the Shopify Inc. v. Shopline case. #copyright #software #digital #platforms

The digital frontier is an ever-evolving landscape where ideas can be effortlessly replicated, making intellectual property rights the thin line between innovation and stagnation. In this ephemeral realm, copyright protection stands as a bulwark against the relentless tide of imitators, safeguarding the very essence of creativity that fuels the digital revolution. The Shopify Inc. v. Shopline case serves as a poignant reminder that the intangible nature of software does not diminish its inherent value or the need to shield it from unscrupulous duplication. Just as the written word carries the weight of an author's intellect, the intricate tapestry of code that breathes life into digital platforms deserves the same reverence and legal safeguards. In an age where digital platforms are the foundational blocks upon which entire industries are built, the notion of intellectual property transcends mere legal jargon and becomes a sacred compact between innovators and society. It is a covenant that ensures the continuation of human ingenuity, fostering an ecosystem where ideas can flourish, unencumbered by the specter of intellectual piracy.Copyright, in this context, is not a mere restraint but a catalyst for boundless creativity, a testament to the indomitable spirit of human innovation that has propelled us from the depths of ignorance to the pinnacles of technological marvels. It is a clarion call to embrace the sanctity of original thought, for in doing so, we pave the way for a future where the digital frontier remains an infinite expanse of untapped potential.

Nintendo continues to prove that it is the most active hunter for copyright and IP infringement in the game industry. You screw with Nintendo at your own peril. Nintendo vs piracy hunting is a 4 decade-old story.-----Modded Hardware complaint PDF: https://lnkd.in/gBawWjceArchbox complaint PDF: https://lnkd.in/gC7XAGvu-----[Original Source Article]TorrentFreak: "Nintendo Sues ‘Modded Hardware’ and r/SwitchPirates Moderator ‘Archbox’""Nintendo has filed two lawsuits at a Washington federal court, targeting individuals who allegedly facilitated Nintendo Switch piracy. The first lawsuit accuses Modded Hardware of violating the DMCA by selling mod-chips and MIG devices, as well as shipping modded consoles with pirated games. The second complaint accuses 'Archbox', a moderator of r/SwitchPirates on Reddit, of facilitating piracy and operating various 'pirate shops'."TorrentFreak: https://lnkd.in/gB_w9y4s-----MyNintendoNews: "Nintendo has sued a Switch modder & Nintendo piracy Reddit mod""It is an understatement to say thatNintendohas been engaging in a war on piracy. There are now 2 new examples of the company’s latest attempts to put an end to piracy. One of them, Nintendo says, is a Nintendo Switchmodder enabling piracy. Another is the moderator of a Nintendo piracy Reddit group. It has been confirmed that Nintendo is suing Ryan Daly, a modder who Nintendo claims runs a company called Modded Hardware. According to Nintendo’s lawsuit, they warned Daly in March to cease selling modded Switch consoles and MIG switches, which was enabling people to play pirated Switch games on unmodded hardware. Daly is also accused of offering a mail-in service where customers could send in their Switch consoles so they could be modded and receive pre-installation of pirated games. Nintendo alleges that Daly agreed to stop, but continued his activities anyway. Nintendo is accusing Daly of 6 charges, including copyright infringement and “trafficking in circumvention devices”.Nintendo is also suing James Williams. Nintendo is accusing Williams of being “operator, overseer, and driving force behind several Pirate Shops, through which Defendant has offered massive libraries of pirated Nintendo Switch games”. Williams was also a moderator for the r/SwitchPirates group on Reddit, where he used the name Archbox and, according to Nintendo, became a place where Williams would direct users to his pirate shops, as well as providing technical advice on how people can mod their Switch consoles and play pirated games.MyNintendoNews: https://lnkd.in/gF5vZE2G-----Kotaku: "Nintendo Gave Switch Pirates A Chance To Walk Away But They Apparently Refused. In 1997, Steve Jobs retook Apple, the company he founded, which, after being driven out of it, effectively ended up on the verge of bankruptcy. Bill Gates offered him help at that point, which Steve Jobs accepted. This move surprised everyone because the two had been main competitors for many years. Initially, after its founding, Steve and Bill collaborated in the development of their companies, and over time the rivalry between Apple and Microsoft grew, culminating in the 90s, when a legal battle flared up between them, including allegations of copyright infringement. The personal computer market was a key field of their bidding. Macintosh and Windows had become competing platforms, and the struggle for market dominance had led them to sharp conflicts in public and marketing campaigns. In those years, Apple was sinking more and more and its market share fell from 5.2% to 3.1%, and the stock value was at its 10-year low. Unlike Apple at the time, Microsoft was extremely successful and offered them a hand of salvation. The key elements of the aid were:1. Microsoft had invested $150 million in Apple shares. This investment was important for its revival, but also for restoring the confidence of other investors in the future of the company.2. It was agreed that Microsoft would continue to develop software for Macintosh as well, and this collaboration contributed to Apple's survival because Windows was extremely popular.3. As part of the deal, longstanding legal disputes between Apple and Microsoft were also resolved, including lawsuits related to copyright infringement. This contributed to reducing unnecessary legal and other costs and creating a more positive environment for both companies.Bill Gates recognized the importance of preserving competition and maintaining market balance, and this collaboration was critical to Apple's survival and allowed it to re-focus on Steve Jobs-led innovation, which later led to the impressive development and rise of Apple. In 2010, Apple became a more valuable company than Microsoft, and since 2011 it has been the most valuable company in the world. Its market capitalization broke the $3 trillion mark last year. If Microsoft still holds then purchased shares of Apple, then on the $150 million invested today it has a value of $162.8 billion, i.e. the return on investment is 1085 times. Of course, Microsoft is the second largest company in the world and currently has a value of just under $3 trillion and has the best chance of becoming the second company in the world to pass that threshold.Steve Jobs and Bill Gates have left an indelible mark on the tech world, and their relationship can be described as a complex mix of collaboration, rivalry, respect and a shared impact on the development of the computer industry and the business world.*Information and image courtesy: an anonymous article shared in a professional forum I am a part of.

You can get banned on Amazon for something you didn't even know aboutHere are the 3 most common ones to avoid:1. Selling Generic branded listingsThese listings are made by unauthorized sellersAnd it's technically copyright infringement to sell on theseAmazon started cracking down on these, don't sell if the brand name is wrong2. Section 3 ReviewAmazon randomly does this to new sellersYou just have to prove you buy legit inventory Stick to real retailers and wholesalersHaven't seen anyone buying legit inventory lose this3. Competing with brand ownersThose brands can give you IP complaints or counterfeit complaintsAvoid listings that have steep seller count drops and the brand themselves on itOne won't ban you but getting several canGeneral rule of thumb is if it's too good to be true, it probably isTelegram "wholesalers" and fake websites have cost people their businessBe safe out there!

Importance of Patent & Copyrights in Amazon WorldOne of the colleague who was working with us on multiple projects has leaked the product details and gave the same product to his own investor when he started his own agency. He knew the supplier details as well and even manufactured the same product for same supplier by changing the brand name.Initially we didn't notice but after 10 days our market share started dropping as he was hijacking sales by selling same design which was patented. That guy made a mistake as he manufactured approx 8k units and few hundred units were live in FBA while remaining were in the sea and on the way to FBA.We ordered his product from amazon and realized the product is 100% copy. We simply filed the copyright infringement on his account and amazon removed his listings. We got our Sales and BSR backNow same person is contacting us to help us in reinstating the listing as he wanted us to provide consent to amazon to allow this seller otherwise whole inventory will dispose off. He will simply liquidate his inventory at a cheap cost to local retail market nowMoral: Never ever mess any patented seller in amazon by selling same design. Do R&D and come up with different innovative approach.

Games are a great place to rekindle these pop culture IPs. Robocop is a great example of what you might call a "goldilocks IP" IMO which is a concept I learned from Funko – 1) nearly universal recognition and widespread affinity, 2) compelling world that lends itself to video games and that gamers want to explore 3) underexploited and somewhat dormant, 4) friendly IP owner / creator who is easy on approvals and willing to get out of the way.IPs like Star Wars and Marvel can be great, but you're not signing a deal for less than $10m MG (or more), they will demand a AAA budget of $200-300m, and you will get lots of "help" from the IP holder (some good, some not so good).IMO, there are some great opportunities right now in these AA IPs."For some IPs, the best route is to relaunch the IP as a game, not a movie/series. “Hogwarts Legacy” is perhaps the best example of a game recharging an IP and paving the way for more audiovisual - but I’d also point to the likes of “Robocop: Rogue City,” a game garnering strong word of mouth for its spot on depiction of that world. I hadn’t thought about Robocop for a decade before I played it. Now I’m hankering to watch the movies again. Note that taking this route doesn’t necessarily mean a AAA budget - pixel art or AA is also a viable approach for many IPs."
